Terms of Service

By creating an account or using MyDigiSence (the "Platform"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform. These Terms form a legally binding agreement between you and Digiconn Unite Pvt. Ltd. ("we", "us").

You must be at least 13 years old to use the Platform. By using the Platform, you represent that you have the legal capacity to enter into this agreement. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

• You are responsible for maintaining the confidentiality of your password.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at mydigisence@gmail.com if you suspect unauthorised access to your account.
• You may not share your account credentials with third parties or create accounts for others without their consent.

You agree not to:

• Post false, misleading, or fraudulent information about yourself or your services.
• Harass, threaten, or harm other users.
• Upload content that infringes third-party intellectual property rights.
• Use the Platform to send unsolicited commercial messages (spam).
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts.
• Scrape, crawl, or use automated tools to extract data from the Platform without written permission.
• Use the Platform for any unlawful purpose or in violation of applicable laws.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

You retain ownership of content you post on the Platform (profile text, images, service descriptions, etc.). By posting content, you grant us a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute that content solely for the purpose of operating the Platform.

You represent that you have the right to post all content you submit, and that your content does not violate any third-party rights or applicable law.

The Platform offers Free, Pro, and Enterprise plans. Paid plan details, pricing, and features are described on the Pricing page.

• Subscriptions are billed monthly or annually in advance.
• Payments are processed by Stripe. By providing payment details, you authorise us to charge your payment method for recurring subscription fees.
• Refunds are provided at our discretion for unused portions of annual plans; monthly plans are non-refundable.
• We may change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

The Platform, including its software, design, trademarks, and all content created by us, is owned by Digiconn Unite Pvt. Ltd. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our written permission.

The Platform integrates with third-party services (Stripe, Google, etc.). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the practices of third-party services.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Digiconn Unite Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

You may delete your account at any time from your dashboard settings. We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your right to use the Platform ceases immediately. Sections 5, 7, 9, 10, and 12 survive termination.

These Terms are governed by the laws of India. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Agra, Uttar Pradesh, India. Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us at mydigisence@gmail.com.

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or a platform notice. Continued use of the Platform after the effective date of the revised Terms constitutes your acceptance.
